Florida Governor Ron DeSantis Scores Major Legal Victory in Fight to Ban Mask Mandates for Kids in School

Governor Ron DeSantis continues to fight for the rights of parents in the state of Florida.

DeSantis has banned mask mandates for children in schools across the state.

Instead, DeSantis believes in allowing parents to decide what’s best for their kids.

An emergency motion was filed by the DeSantis administration. The motion asked an appeals court to reinstate a stay on his order to ban the mandates.

DeSantis scored a major legal victory when the 1st District Court of Appeal in Tallahassee decided to grant the stay.

Christina Pushaw, a spokeswoman for Gov. DeSantis, explaine, “1st District Court of Appeals just granted the State of Florida’s request to reinstate the stay — meaning, the rule requiring ALL Florida school districts to protect parents’ rights to make choices about masking kids is BACK in effect!”

DeSantis correctly predicted that the appeal would ultimately prove successful, Daily Wire notes.

“It’ll be appealed. We’ll end up getting it back,” DeSantis told reporters. “At the end of the day, ultimately, we’re just trying to stand with the parents.”

Recently, the world is clearly spiraling out of control under Joe Biden’s watch.

We’ve witnessed the disaster in Afghanistan, a tremendous surge in COVID, a catastrophe at the southern border, the destruction of U.S. energy independence, and the crippling of our economy.

Meanwhile, as Biden horribly mishandles his own duties, he has found time to complain about how states like Texas and Florida governors are running their own administrations.

Biden launched an “all out smear campaign” against Florida and Texas, Trending Politics notes.

Biden told Florida Governor Ron DeSantis and Texas Governor Greg Abbot to “get out of the way.”

“Florida and Texas account for 1/3 of all new covid-19 cases…,” Biden said, completely ignoring the low death rates. “I say to these governors ‘please help.’ But if you aren’t going to help, at least get out of the way of the people trying to do the right thing.”

Fox News reporter Peter Doocy responded, “President Biden says that we are not returning to lockdowns, shutdowns, and school closures, but he also once said that we didn’t have to wear masks anymore once we were vaccinated. So why should Americans trust him that?”

The White House’s Principal Deputy Press Secretary Karine Jean-Pierre said, “Well, because we listen to the scientists, we listened to the expert[s]. This is a public health situation. This is not about politics at all. This is about saving lives. And this is what the President is all about. He wants to make sure that we are saving lives.”

“If you look at … the last six months. That’s what he’s done, every day. And you see that in the numbers. Now we’re at a point where we have to double down and make it very, very clear to people that we can’t, we can’t let the pandemic win, we have to continue to fight.”

“So, if you’re listening to the scientists, if scientists come to you at some point down the line and say it is our opinion that there should be shutdowns and there should be school closures, you would do that?” Doocy asked.

“Well, we listen to, like I said, we listen to the CDC and the expert[s] and their guidance…are, you know, the CDC is a body that is very well respected,” Jean-Pierre responded. “And again, we follow their guidance.”

More from Daily Wire:

DeSantis filed an appeal last week to reverse a ruling from a Leon County circuit judge who struck down his ban on schools implementing mask mandates, The Daily Wire previously reported:

The appeal, filed at the 1st District Court of Appeal in Tallahassee, is aimed at overturning the decision of Judge John C. Cooper, a Leon County Circuit Judge. Cooper previously said that DeSantis had overstepped his state authority in his July executive order on masking in schools.

Looking at the legislation and orders in question, Cooper said that masking mandates do not need to “include a parent-opt out at all,” according to The Associated Press.

The ruling enabled Florida county school boards to put mask mandates in place if they choose. Yet, as the AP reports, DeSantis’s appeal now stays the ruling, meaning that it’s at least temporarily suspended.
